TERMS & CONDITIONS FOR NEW DOMINION PICTURES AUCTION:
Remember that placing a bid contractually binds you to paying for an item. You are required to pay for all items you bid on and win in this auction, WHETHER OR NOT you pick them up.

AUCTION END DATE: Tuesday, January 14, 2025, beginning with Lots #1 @ 10:30 AM & 1 item every 20 seconds thereafter, unless an item's time is extended.
AUCTION INSPECTION: Monday, January 13, 2025, 9 AM - 4 PM.
We want you
to get the best deal possible and encourage you to inspect all items before
bidding. Due to the number of items we sell, we do NOT have time to test or closely examine items. All due diligence belongs to the bidder. If you have
any questions pertaining to a specific lot, please call 757-512-8833 BEFORE
placing a bid! If you cannot make it to the preview, but have questions on
specific items, you may call Natalie at 757-287-8797 or Tucker at 757-512-8833, DURING THE PREVIEW, and we will be happy
to send you additional pictures/video of the items or look more closely at an item, to answer your questions. We will NOT be able to answer questions about items once we have left the preview. No one will be at the auction site on Tuesday, January 14th.
WARRANTY, CONDITIONS & DESCRIPTIONS: All items are sold as-is, where-is, with NO warranties expressed or implied, and there are NO refunds given, for any reason. Please read the description & examine the photos when bidding. If you have any doubt when viewing an item, go by the description, as photographs sometimes include items that are NOT part of the lot or are incorrect. NOTE: Auction staff does not test items or examine items in each lot to ensure all parts are present. We strongly encourage you to preview the auction, in person. Neither the auctioneer, nor the seller, makes any warranties or representations of any kind or nature with respect to said property.
STAGGERED CLOSINGS & AUTO-EXTENDED BIDDING: Our auctions feature a Simulated Live Auction Experience with staggered closings, auto-extended bidding and bid notifications via email. Staggered closings allow items to close at a pre-determined rate of 1 item every 20 seconds. We also feature auto-extended bidding, which means that the closing time of an individual lot will be extended by 2 minutes, if a bid is placed in the last 2 minutes of an item's closing. This allows you a chance to place additional bids on an item, if you are bidding manually, in "real time" (and another bidder places a last minute bid) versus taking advantage of our Max Bid feature. These features allow us to closely simulates a "live auction” experience.
AUCTION PICKUP TIME: By pre-scheduled appointment ONLY on Thursday, January 16th from 9
AM - 5 PM, Friday and January 17th from 9 AM to 5 PM. CERTAIN ITEMS MUST BE PICKED UP ON SATURDAY, January 18th. All items, not specified for Saturday pick up MUST be picked up by Friday at 5 PM.
You may request an appointment any time after 9 AM on Monday, January 13th by texting Natalie at 757-287-8797 with your bidder #, your name and your preferred pick-up appointment time.
Please be optimistic! Make YOUR life and ours MUCH easier, by scheduling a tentative pick-up appointment AND specifying your payment method BEFORE the auction ends, while we still have plenty of available time slots.
If you do not win any items, your appointment will be automatically canceled.
If you do not request an appointment in advance, Natalie will email your invoice with 16% BP & text you with an assigned pick-up appointment time. If you schedule a pick up time in advance, and then win lots that need to be picked up earlier or later, Natalie will contact you to reschedule. Please be flexible.
An invoice will be emailed to successful bidders after the auction ends on Tuesday, January 14th.
We have OVER 200 buyers, so you will need to be patient AND flexible with your pick up times. Natalie does her best to facilitate a smooth pick up experience for all bidders, despite having to average over 50 items removed per hour, over the 2 day removal period. If you win lots that are displayed on top of tables, shelving units, racks or desks, you will need to pick up on Thursday. If you win lots that are tables, shelving units, racks or desks, you will need to pick up those item on Friday, even if it requires you to schedule an appointment to pick up on EACH DAY.
Additional time MAY be possible, based on scheduling availability of auction staff, at an additional hourly rate of $50/hour, including travel time. Additional time must be paid by cash only. There will be no additional charge, if an item you purchase SPECIFIES additional time, in the description.
Once you have been notified of winning an item, the item contractually becomes
yours, and any fees associated with moving, removing, disposing of, or
collecting payment, whether physical or legal, are the responsibility of the
bidder.
PAYMENT & AVAILABLE CASH DISCOUNT: You will receive an invoice Tuesday afternoon, with your total which will include a 16% Buyers Premium (discounted to 12% for cash ONLY for bidders who tell Natalie PRIOR TO THE CLOSE of the auction that they will be paying cash). No cash discount will be given once the auction has ended, and the invoices have been formatted and emailed. Credit cards being used for payment must be saved in your Bidder Profile, and marked as PRIMARY, as all credit card payments are processed online only. If you do not let Natalie know that you are paying by cash or business check by 5 PM on Tuesday, January 14th, the credit card in your Bidder Profile will be charged for your invoice total, late Wednesday, the day after the auction ends.
If you are paying by cash or business check, your invoice must be paid, in full, when you arrive for your scheduled pick up time.
No charge backs or refunds will be allowed, for any reason.
SALES TAX: This auction is tax exempt.
ABANDONED ITEMS: ALL ITEMS MUST BE PICKED UP NO LATER THAN 5 PM FRIDAY, JANUARY 17, 2025. Items not picked up by this time will be considered abandoned, unless permission for an extension has been given, in advance, and payment for the additional time has been made. You are required to pay for all items you bid on and win in this auction, WHETHER OR NOT you pick them up. Your credit card, on file, will be charged for your total balance, including the 16% Buyer's Premium, if you abandon your purchases. Should your payment be declined, you will be banned from participating in all future auctions, and the Auctioneer will pursue legal recourse to collect the amount you owe. All attorney's fees, court costs, and other legal fees will be the responsibility of the Bidder. In addition, interest will accrue on any unpaid balance, at the rate of 12% per annum, until the balance is paid in full.
